- User
- A person or an entity who uses services in accordance with the Agreement signed with the service provider.
- Active User
- A person or an entity who has one or more active services.
- Inactive User
- A person or an entity without any services or whose services are cancelled or terminated.
- Visitor
- A person or an entity browsing the Provider's website at https://hostingwalay.pk.
- Services
- Either or both services and products provided by the Provider and available via the Provider's website.
- Downtime
- A period of time when a service is inactive or inaccessible.
- Monthly Services
- Services that are applied instantly or provided for a 1-month period.
- Long-Term Services
- Services that are provided for more than a 1-month period.
- Primary Language
- English.
- Secondary Languages
- Urdu.
- Primary Currency
- PKR (Pakistani Rupee).
- Secondary Currencies
- USD.
- Billing Cycle
- A predefined interval of time between two recurring payments.
- Billing Account
- The account at https://hostingwalay.pk holding a summary of all types of services provided to the User. Also entitled as Client Area.
- Credit Balance
- The amount of funds in the User's account.
- Confirmed Affiliate Income
- The amount of money that the User earned through the Affiliate System.
- Reseller
- A person or an entity who is accepted to the HostingWalay Reseller Program and gets access to the services and benefits of the program.
- Affiliate Earned Funds
- The amount of money that the User received.
- Complaining Party
- The User or an interested 3rd party that submits a report concerning the violation of the Acceptable Use Policy.
- Authorized Payments
- Automatic transactions that are pre-approved by the User.
1 Intellectual Property
The Terms of Service does not give or transfer the User any rights to intellectual property that is not in his possession.
All rights to the software used during the process of service provision are protected and belong to the Provider, or the Provider is authorized to use them.
Logos, brand marks, website content, design, and original code published on hostingwalay.pk are the property of HostingWalay. Unauthorized reproduction, distribution, or commercial use is prohibited.
2 Collected Private Information
In order to use the website and the services, the User is required to register and provide his or her personal information during the registration.
Collected private information is not disclosed to any third party by the Provider, unless specifically stated otherwise in these terms — for example, in cases when appropriate legal authorities (PTA, FIA, court orders) request such data in case of criminal activity performed by the User or through the User's account.
The Provider reserves the right to use all of the information provided by any visitor, which he or she submitted during the registration process, as well as any other information about his activity within our services.
The Provider reserves the right to use all the collected private information, including (but not limited to) the User's email address for service-related and marketing purposes.
By signing up or providing his or her personal information, the User agrees to receive service-related and marketing information sent to him or her by the Provider.
What information do we collect?
- Identity data — full name, CNIC / NTN (when required), date of birth (where applicable).
- Contact data — email address, phone number, mailing address, country, city.
- Account data — username, encrypted password, security question and answer.
- Billing data — invoice records, payment method type, transaction history. We do not store full credit card numbers — these are tokenized by the payment gateway.
- Service data — hosting plan, domain names, services purchased, support ticket history.
- Verification documents — CNIC / NTN / letterhead / IP justification (required for PTA-compliant Pakistan-VPS allocations).
3 Collected Anonymous Information
The Provider may collect certain information every time the visitor or the User visits the Website in order to provide higher quality services to the users of the service.
The collected anonymous information includes (but is not limited to) visitors' IP addresses, related data (e.g., the internet address of the last website which the person has visited before his/her visit to the website, browser and operating system types, common search yields from various search programs, oriented towards internal advertising, popular search words, etc.).
The Provider may collect and conserve the indicated information about all and any visitors, regardless if they are registered or not.
4 Cookies Policy
The Provider may collect certain information using cookies in compliance with privacy and data protection laws and regulatory framework.
The tracked information is used to supply, improve and manage the services. The use of the tracked information includes research, statistics and advertising purposes.
The tracked information is not transmitted to 3rd parties in any circumstances.
Types of cookies we use
- Essential cookies — required for the Client Area login, shopping cart, and checkout flow.
- Functional cookies — remember your preferred currency (PKR / USD), language, and recently viewed services.
- Analytics cookies — Google Analytics and similar tools to understand site usage and improve UX. IPs are anonymized.
- Marketing cookies — Facebook Pixel, Google Ads remarketing tags (only set after explicit consent on the cookie banner).
Users can disable cookies via browser settings, but doing so may break checkout, login, and other interactive features.
5 Data Sharing & Third Parties
HostingWalay does not sell User data to advertisers, data brokers, or any third party.
User data may be shared only in the following limited circumstances:
- Domain Registries — WHOIS data submitted to PKNIC (.pk), Verisign (.com / .net), or other registries as required by registry rules.
- Payment Gateways — transaction details sent to JazzCash, EasyPaisa, Stripe, PayPal, or banks to process payments. We never store full card numbers.
- PTA / Government — identity and IP allocation records shared with the Pakistan Telecommunication Authority for compliance with telecom regulations.
- Legal Authorities — in response to valid court orders, FIA / cyber crime investigations, or law-enforcement requests.
- Service Providers — trusted infrastructure partners (datacenters, SMS gateways, email delivery services) bound by confidentiality agreements.
6 Data Retention
The Provider retains User data for as long as the Billing Account is active plus a reasonable period thereafter to comply with legal, tax, and accounting obligations.
Billing and tax records — retained for a minimum of 6 years in line with Pakistani regulatory requirements.
Service data and backups — retained for 15 days after service termination, after which it may be permanently deleted.
Support ticket history — retained indefinitely for quality, training, and dispute-resolution purposes (anonymized where appropriate).
7 Your Rights
As a User of HostingWalay, you have the following rights regarding your personal data:
- Right to access — request a copy of all personal data we hold about you.
- Right to rectification — update incorrect or outdated information from your Client Area or by raising a ticket.
- Right to erasure — request deletion of your data, subject to legal retention obligations (billing records, etc.).
- Right to object — opt out of marketing emails using the unsubscribe link in any communication.
- Right to portability — request your data in a machine-readable format (CSV / JSON).
- Right to lodge a complaint — contact the Pakistan Data Protection Authority (when established) if you believe your rights have been violated.
Email privacy@hostingwalay.pk or submit a ticket from your Client Area. We respond to all valid requests within 30 days.
8 Data Security
HostingWalay implements industry-standard security practices to protect User data, including:
- 256-bit SSL / TLS encryption for all data transmission to and from our systems.
- Encrypted password storage using bcrypt / argon2 hashing — we cannot read your password.
- Tokenized payment data — full card numbers are stored by payment gateways, never on our servers.
- Firewall, intrusion detection, and DDoS protection on all infrastructure layers.
- Tier-III datacenters with biometric access, 24/7 surveillance, and N+1 power / cooling redundancy.
- Regular security audits, vulnerability scans, and staff training on data-handling.
Despite reasonable precautions, no internet transmission or storage system is 100% secure. The Provider cannot guarantee absolute security and recommends Users enable two-factor authentication (2FA) on their Client Area and choose strong, unique passwords.
In the unlikely event of a data breach affecting User data, the Provider will notify affected Users within 72 hours of discovery via email and provide guidance on protective measures.
